1. [Domesday Book – Vol 2 “ Sussex , + Vol 35 Suffolk – General Editor John Morris (Phillimore 1972)]

‘In Isteda 1 free man, over whom Bishop Aethelma had the commendation, with 10 ½ acres and the fourth part of a mill. 1 bordar. Then half a plough, now 2 oxen. It is worth 2s. William MALET held this; afterwards Robert his son (held it), thinking it belonged to his father’s fief.’

{The Domesday Book indicates that at the time of the survey 1085 this land was retained in ‘the King’s hand’ (William I – the Conqueror). This is the earliest mention or record of the name in the “I” form in England or anywhere else. No surname of “de ISTED(E)” listed. It is possible that the place “Isteda” could have had some connection to ISTED (see ISTED Origins paper by Kevin Isted www.isted.info }

1200-1300

2. [Book - Suffolk Manors by Copinger 1905 – pages 99-102*] It mentions Manor of Isted in Weybread, county of Suffolk 1225. {we suspect this is the same place as Isteda in reference 1.}

item: Feoffment in free alms [ HD 1538/345/1/36*] - date: n.d.[early 13th century] from Scope & Content - (1) to (2) in free and pure alms, tenement which Maurice, son of William the miller held of (1) in Histede , and service for said tenement, viz. 12d. annually (6d. at Easter and feast of St Michael), 8 days' work in August without food and 3 hens at Christmas; and homage of Maurice and all his family; free of all secular demand except King's scutage of 7½d. in 20s. and ½d. castleguard. Warranty clause. Witnesses: Werreys de Cham', Norman de Peshall, William de Falesham, William de Blancheuill, Matthew de Stradebrook, John his son, Robert Jurdi, Ranulf Cemencar.’

{Histede was probably Isteda &/or Manor of Isted/Istead/Instead & Instead Hall Farm in Weybread, county of Suffolk; all look to be one and the same place; see references 1, 2, 11.}

Article Custumals of Sussex Manors of the Archbishop of Canterbury

‘In the year about 1285, for the borough of Maufeud (Mayfield) in the Rape of Pevensey; Sussex -

John de YSTEDE/ISTEDE , freeman, holds 12 acres of land for 12d.

William de YSTEDE/ISTEDE , freeman, holds 1 virgate of land (in the forest area of Mayfield) containing about 100 acres for 5s 4d paid at the four terms of the year, namely at: Christmas - 2s, Easter - 16d, Midsummer - 12d, and Michaelmas - 12d. And that he must hunt with bow and arrows for 12 days, and he must carry three cartloads of wood in his own wain to South Malling. He owes one hen and ten eggs at Christmas and he shall give gavelsuen if he has three pigs. He must help in keeping one nest of sparrow-hawks and the keeping is worth ½ d. He owes suit at the lord’s court.

He also holds 1 ½ acres for 3d, paid at the same terms.

Also William le CUPERE, freeman, holds of William de ISTEDE, freeman, gives 1 hen and he shall give him (eidem) a pig if he has 3 pigs. Gilbert FABER, neif, holds of the same William and he does not give a hen.

Emma de ISTEDE , freewoman, holds 20 acres of land of which 2 acres is coppice for 7 ½ d, at Easter 3 ¾ d, and Michaelmas 3 ¾ d. She owes suit at the lord’s court.’

1300-1400

5. [Book - Sussex Record Society - Volume 10, pages 199* & 310*]

Sussex Subsidy Rolls of Years 1296, 1327 & 1332.

This is a record of the names of contributors to the Tax on Moveables, which was the earliest form of general taxation.

Year 1296: No mention of any ISTED. However, William and Emma de ISTEDE, like others who held land directly from the Archbishop of Canterbury, were exempt from the taxation. In Reaney’s book (see item 8) there is a Helewis {a female} de HEGHESTEAD , but not sure what parish this entry is in. We can confirm it was not listed in the Loxfield Hundred, although some parts of the document are not legible.

Year 1327: (page 199) Villat de Maghefeld & Wadehurst (Mayfield & Wadhurst):

Simone de ISTEDE was taxed at 1s 6d; and Joha ISTEDE was taxed at 1s 3d.

Year 1332: (page 310) Villat de Maghefeld & Wadehurst:

Symone de ISTED was taxed at 1s 7d; and Joha de ISTED was taxed at 1s 5d.

{Joha ( the ablative form of the Latin form of Joan) was a spinster or widow, otherwise the land and presumably the tax obligation would have been her husband’s. Possibly Simone was a son or grandson, or was in some way a descendant of either William or John de YSTEDE/ISTEDE who were mentioned in the Custumals of Mayfield c1285.}

6. [A2A website – Archive of the PORTMAN family of Buxted Place ; SAS/PN/1 - date: 30 Sep 1388 ]

from Scope and Content –

By Symon YSTEDE of the parish of Notfelde in Southerye to Thomas SKYNNER of Boxstede {Buxted} &Johan his wife of a messuage with 6 ac. of arable land in Bokstede, 4 ac. thereof lying in a field called Hothamme, the messuage being built upon a parcel of the 2 ac. and another parcel of the said 2 ac. being called Robynshake Saving to the said Symon and his heirs ½ rood lying in the South part of the said lands called Robynehake.’

{If the above mentioned Symon lived to an old age (60-70s?) he could be the one listed in the 1327 & 1332 Sussex Subsidy Rolls, but more than likely he was a descendant – either a son or grandson of Simone de ISTEDE. It may be a coincidence but I have several early ISTED families (late 1400s through to 1500s+) of Nutfield & Bletchingly in Surrey . I wonder if this Symon had moved away from Mayfield/Buxted and settled in the parish of Notfield (sic Nutfield?) - however I am not sure about the place name “Southerye”. It would depend whether this place is in the county of Sussex or Surrey .}

By John ISTEDE, son and heir of Laurence ISTEDE , late of Framfeld, to Agnes SMYTH, late wife of John SMYTH of Asshbornham of and in lands, tenements, &c called Scottys in Asshbornham which descended to the said John ISTEDE on the death of his father, which the said Laurence ISTEDE, with John PONTE decd., had by feoffment of Thomas CAPENORE, father of the said Agnes SMYTH. Seal.’

{above Laurence probably born about mid-1400s; possibly a descendant of the de ISTEDEs of Mayfield; Laurence is possibly Bruce ISTED’s 13xgt-grandfather; Kevin ISTED’s 14xgt-grandfather.}.

1500-1600

{unsure as to who/how Thomas links but possibly he is same person as in references 8 & 9.}

‘To the King. Complaint of John MONE and Richard ISTED , who state that one William NUSELL of Mayfield, county of Sussex, of late intended to have murdered the said Richard ISTED , and made overtures to one William BAKER for the accomplishment of the same, and sent the said William BAKER to one John DOWNE, and willed the said William BAKER “to make hym a hode,” for he said that “the said MONE shuld be browght to Mayfield and there to be bounden to a post in the myddest of the same towne’. Complainants state that William NUSELL and his adherents assembled to destroy the park of the Archbishop of Canterbury called “the plasshett,” in the county of Sussex , and that the said NUSELL is “a person of noo good name and fame,” and intendeth to destroy other nobleman’s parks in those parts. The answer of William NYSELL (sic) is a general denial.’

{Richard born c1500/05 possibly son of John ISTED; died 1541/2 Mayfield – he was the Ironmaster}.

page 126: Richard ISTED listed in Hundred of Loxfield (Framfield) was taxed at £6.

page 149: Richard ISTED listed in Hundred of Hawkesborough (Bivelham, Mayfield) had land taxed at £3 6s 8d.

{Richard ISTED was an Ironmaster of the Moat Mill Forge in Mayfield in early to mid 1500s}

‘JC surrenders land to the use of his son James et al. according to arbitration made by Richard ISTED , William PENKEHERST, John STEVYN and John LONE.’

{ Richard born c1500/05 died 1541/2. An arbitrator is a person appointed to settle disputes. }.

17. [Book - Sussex Archaeological Collection Volume 14, page 82*] - article Notices of Hastings .

The Benevolance Return of Henry VIII (1544) for the town of Hastings in Sussex , gives us the names of the principal inhabitants of the town at that time, with the amount of their contributions. Among the 48 names listed was a John ISTED who gave £3.

On 13 March 1553 (Edward VI’s reign): ‘It is licensed to John ISTED , One of the Burgesses for Hastings , being a Purveyor for the King, to be absent.’

In 1546 John ISTED , Jurat, presented the following account as Burgess to Parliament {Henry VIII reign}:

First from 13th Nov. unto 30 Dec. @ 2s. a day £4 14 0

Item from 11 Jany unto 6 Feby 25 days £2 10 0

Item from the last day of Octr to the 26 Dec. £5 12 0

Item more given in reward to the Kings Atty for drawg for the Ports £ 0 02 0

Item to the Sergt. of the Parliamt House £ 0 02 0 (total £13).

In theory each of the 5 Cinque Ports elected its own Burgesses, but the Lord Warden was an important man, as the following letter to the bailiff written in 1553/4 shows:

‘Forasmuch as there shall be Burgesses chosen for the Ports, I would have ISTED my servt to be one for Hastings, for so he was the last time & I will appoint the other, and Captn SHUTE if he will or his Bror to be one for Winchelsea and I will appoint the other.’

So on March 11th in the 1st year of Queen Mary’s reign (1554) John ISTED & John FRANK were chosen to attend Parliament at Oxford . John served in Parliament during the reigns of three monarchs – Henry VIII, Edward VI and Mary 1.

20. [Book - Sussex Archaelogical Collection Volume 3, pages 240-245*]

Ironworks of the County of Sussex . In 1574 Thomas ISTED , Ironmaster of Hawkesden Forge in Mayfield, East Sussex, was included in a list of the Ironmasters of Sussex Surrey and Kent, and was among those who had to furnish a bond to the value of £2000 for not founding or selling ordnance without licence from the Queen.

{Thomas ISTED 1541-1596, was a son of Richard & Joane ISTED who were Ironmasters of Moat Mill Forge in Mayfield. And this Richard ISTED may have been a possible brother to John ISTED c1515-1556/7 - Bailiff/Jurat/MP of the Hastings Cinque Port.}

21. [Book -Sussex Archaelogical Collection Volume 14, pages 100* & 102*] Notices of Hastings.

Richard ISTED , bc1554 (son of John & Anne ISTED) was among the first Jurats of Hastings following the granting of a charter to the town in 1588 (the year of the Armada by Queen Elizabeth I). The first Mayor of Hastings, Thomas HAY was a relative of Richard ISTED.

{HAY’s first wife was the daughter of John BAKER/Elizabeth ISTED of Mayfield.}

This is a list of free and customary Tenants for the parish of Framfield in East Sussex .

Richard ISTED , gentleman, had a yearly rental payment of £1 18 shillings 3 pence. Also the same Richard for Lucais Land paid 4/6.

{Richard lived c1554-1617, married Ann WARNETT c1575. He was possibly Bruce ISTED’s 10xgt-grandfather; Kevin ISTED’s 11xgt-grandfather.}.

24. [Book - Historic Hastings by J Manwaring BAINES (1986) p261*] Chapter 34 “Inns & Alehouses” -

‘The restriction on the numbers of manufacturers allowed is shown by the small number of brewers permitted to exercise their trade in the town on payment of a fine for so doing. From 1596 to 1786 only the following names are recorded, the older firms being carried on by members of the family until they died out: among the list of only 8 names was, John ISTED 20 August 1614 paid 13s 4d.’

{John ISTED was probably either:

25. [Fiche - Eastern Sussex Contributors to the Relief of Irish Protestants 1642 ]

‘On 23 March 1642 , Parliament passed an Act for speedie contribution & loan towards the reliefe of his Majesties distressed subjects of the Kingdom of Ireland .’ (Total No. Contributors: 3871 from 57 parishes)

Lewes, All Saints: 30 March 1642 Mr ISTED donated 5/-[PRO: SP 28/194/607] {ie Richard 1605-1654}

Waldron: 27 March 1642 John ISTED donated 1/-; [PRO: E 179/191/390] {Jn 1608 Framfield-1662+}

Warbleton: 30 March 1642 John ISTED donating 6/-; [PRO: E 179/191/390] {ie Jn bc1600/5? s/o Edw.}

{In mid-1600s, 10/- was said to be a large sum of money but that was the going rate for a gentleman.}

26. [ESRO Document - Sussex Quarter Sessions Order Book 1642-1649 ; QO/EW1*] October 1649 -

‘At the General Quarter Sessions at Lewes on 14 January 1646, the highway from Bodle Street to Hoods Corner in Warbleton was found to be in a dangerous condition because Edward ISTED , owner of Trumpets Farm and his tenant William PRICE, had dug “myne pitts here in the sayd waye”.’

This antisocial pair responded to request for compensation with derision and abuse, and were bound over until the following Sessions for refusal & contempt. Since three years had passed since the original complaint, it seems that Edward ISTED and William PRICE had found digging up the road profitable!’

{Edward ISTED probably born 1584/5 died c1651; he was the son of Richard & Ann of Framfield & Hastings. Edward is Bruce ISTED’s probable 9x great-grandfather + Kevin ISTED’s probable 10xgt.}

27. [A2a website - Archive of Drake and Lee of Lewes, solicitor - File Deed of Covenant - ref. S AS-D/205* - date: 8 Feb 1647 ] from Scope and Content –

Also of freehold lands being the whole free yard of Isted . Also the following new freehold lands (theretofore assert lands) and heretofore called Isteds Reede , Middle Reede, Pett Reeds alias Pikereede and Gilhawe containing 24 ac.: All the beforementioned premises being then called the Deane, Westfield, the Tenne acres, the orchard field, Bentley feild, Norrisfield, the Istede , the Longcroft, the Great meadow alias Conyberry field and the Kitchenfeild, containing 143 ac. all in Mayfeild at or near Duddesland, to lands of Thos. Relf, E., Thos. Westgate, N. John Tyherst, N.W., the Common called Pounslye wood, W. and S., the Common called Waldron down, S., the highway from Duddesland to Blackboyes, E. and S.E.’

{All these places seem to be in or near Duddesland (with various spellings) in Mayfield, apart from the first reference (item 16) to “Istedes Broke” (presumably Istede’s Brook). Whether any of these places existed c1285 and may have been the place from which the family got its name is another matter. (see Kevin Isted’s future paper “The Search for the ISTEDE property c1285 – the cradle of the ISTEDs?” that is planned to be on the ISTED website in 2007)}.

28. [Fiche - Sussex Hearth Tax Assessments 1662 ]

The Hearth Tax was a supplementary tax instituted in 1662 by Parliament. From 25 March of that year every dwelling in England & Wales was to be assessed as to the number of hearths, fires & stoves set therein. A tax of two shillings per hearth, etc was set. This was to be paid in two equal installments, the first to be paid on 29 September 1662 . The records list principally the occupiers not the owners.

1683 Court Case re John ISTED, Gent of Trumpets Farm in Warbleton , Sussex -

‘In 1683 a curious case was heard before the Exchequer Chamber at Westminster that Hilary term. The plaintiff was Thomas MARTIN, Lord of the Manor of Bucksteep, and the defendant was John ISTED of Trumpets Farm. John ISTED, who admitted holding the freehold lands of Trumpets, Whiteford Field and Brook, had conveniently managed to lose a 20-acre holding called Dill/Dillands on which the rent was 4s. The case was heard by the Rt. Hon. William MONTAGUE, Lord Chief Baron. Rent for the land called Dill had always been paid until a few years ago. Yet now the defendant denied that he'd ever heard of it, let alone concealed or destroyed its boundaries. After hearing witnesses, the court declared it was fully satisfied that John ISTED did indeed hold Dill, and he was ordered to pay the two years missing rent. A commission was appointed to set out the missing lands by meets and bounds.’

One document also mentions that ‘in about 1651 John ISTED was the son of Edward ISTED, gent of Trumpets Farm, deceased.’

{This is another interesting piece of evidence regarding our ancestor - John ISTED probably born 1600/5 son of Edward (& possibly Margaret nee AVERY?); previously he was thought to be John ISTED born 1626/7 Warbleton son of John/Joane nee TIPPET. However usually court documents do not lie and means John (born c1600-5) did not die until after 1683, so must have been in his late 70s/early 80s.}

In 1712 Ecton Manor was alienated by Ralph FREEMAN to Thomas ISTED who was succeeded in 1731 by his son Ambrose. In 1745 Ambrose ISTED received licence to enclose certain highways in his own lands. He died in 1781 and his estates devolved on his son Samuel. His daughter, Mary married William SOTHEBY. Samuel ISTED died in 1827 and his son died without issue in 1881, when Ecton was passed to his first cousin-once removed, C.W. SOTHEBY; and is at present the property of Lt. Col. Herbert G. ( from Scope and Content on A2A website) ‘According to the abstract of title [HIL/6/5/1] in 1716 Thomas ISTED of Lewes, gentleman, devised a messuage lately divided into two dwellings with gardens, orchard and land (1½ acres) on the west side of South Street to his wife Elizabeth, remainder to the son and daughters of his late sister Frances GODLEY. In 1732 the daughters, Mary MANTLE of Horsted Keynes, widow, Elizabeth CAPON of Ludgate in Surrey, widow and Martha DOLLY of Reigate in Surrey, widow sold their interests to Richard GODLEY, on whose death in 1749 the property passed to his daughter Ann. She, as Ann GATES of Reigate , widow, conveyed it in 1776 to William Robinson of Cliffe, bargeman [HIL/6/5/1-2]. On his death in 1815 it passed to Harry ROBINSON, who sold it in 1826 to Charles BUNTING of Cliffe, butcher [HIL/6/5/8-9]. ‘... Negroes were a very valuable part of the assets of a plantation, as one can see from the rough accounts in a letter 1732 of an Estate belonging to Thomas ISTED, a relative by marriage to the FULLERS, who had just died. The estate contained 1,1 50 acres with an estimated value of £7,573, but this figure includes 72 Negroes at £40 and another 72 described as old, some past labour, some young children, some cripples, but worth £10 one with another. The total value of the Negroes was therefore £3,600, quite a sizeable proportion of the whole estate.’

‘Memorandum Whereas at the General meeting of the Inhabitants of Lindfield in the county of Sussex in Vestry assembled on the 23rd day of March 1820. It was signed by the majority of the inhabitants then present to assist Wm ISTED of Lindfield, labourer with a sum of money not exceeding sixty pounds for and towards paying his strait? passage in expenses of conveying his family consisting of himself, wife and six children to America . And on consideration that the said Wm ISTED did give up all that his messuage & cottage garden and premises situated in Scaynes Hill in the said parish of Lindfield to the Church Wardens & Overseers of the Poor to the said parish for the time being for the use of the said inhabitants of Lindfield for ever. Theft, simple grand larceny on 15 Sep 1825 . Phillis was indicted for stealing on the 26 July, ninety yards of ribbon, value 20s + a locke …. {Phillis sic HISTED b1817 Forest Row/East Grinstead , Sussex daughter of Fanny HISTED; married George ANDERSON 1843 Croydon, Surrey ; died 1890 Croydon.}

54. [ Newspaper , Sussex Times 24 Dec 1830 ] Attempt Forcibly to Eject an Overseer of Poor -

William ISTED , labourer, was indicted for having tumultuously and riotously assembled with a mob of 300 persons, on 12 November last, and endeavouring by force and menaces, to compel - BURDON, assistant overseer of the poor for the parish of Warburton (sic? Warbleton?) to quit that parish. It appeared, that on the day named in the indictment, a mob of between 300 and 400 persons assembled in front of the poor-house of Warburton (sic?) and insisted that BURDON, the assistant overseer should quit the parish on the Monday following by beat of drum. The defendant was the spokesman and ringleader of the mob, and, in stating their determination to enforce the demand, he declared, that unless BURDON left the parish, it would be worse for him. This menace compelled BURDON and his family to quit the parish. This jury found the prisoner Guilty. The prisoner was sentenced to imprisonment and to hard labour.

{NB is possible that the above mentioned William ISTED was one born c1799/1800 Warbleton m1827 Herstmonceux & died 1865 Herstmonceux.}

55. [Historic Hastings by J Manwaring Baines, 1986; article Gaoler’s Diary pages 103-4*]

a) 1850 Jan 30th - Thrue misbehaviour of John ISTED, George WHITE, Henry HOADLEY and William CLARKE. Their fireing was reduct.

b) 1850 February 1st - Thrue Misconduct of John ISTED, George WHITE, Henry HOADLEY and William CLARKE (all as we would say today, “teenagers”). On January 31st singing and swareing. Ordered that ISTED’s allowance be reduced to bread and water for one day, WHITE, HOADLEY and CLARK’s allowance be reduced to one pound of bread per diem for one day only.

c) 1850 April 3rd - John ISTED charged with burning his name in the bench with a hot wire. Ordered that his allowance be reduced to bread and water for two days only. (He seems to have been the ring-leader.)

d) 1850 April 6th - John ISTED blackened Samuel WELLER’s eye.

e) 1850 April 20th John ISTED lead a minor riot, broke combs, singing etc.

‘John MURDOCK, otherwise known as Joseph WILLIAMS, was born in the East End of London in 1836…Having deserted from his regiment he arrived at Hastings, Sussex in Feb 1856 and was shortly afterwards arrested with George WRIGHT, a 12 year old boy, on charge of picking the pocket of Jane ISTED and stealing 1/2d, and he & the boy were committed by Mr TICEHURST the Mayor of the town, to stand trial at the Borough Quarter Sessions; they were sent to gaol.’

57. [Victorian Village - Diaries of Rev. John Coker EGERTON of Burwash 1857-1888, published by Alan Sutton, 1992; ISBN 07569 0274] There are a large number of references to the name ISTED in this book but I’ve only selected 5 of the more interesting ones:

a) 1858, 21 Dec: 31yr old John ISTED summoned with PAYNE.

They were disturbed while poaching in Park Wood by one of the Fuller Meyrick’s gamekeepers. PAYNE levelled his gun at the keeper and exclaimed “Stand back, if you come one inch further I’ll blow your brains out” in what had all the makings of yet another exemplar of vicious confrontations between poachers and keepers. However the gamekeeper ‘stood still’, and when his colleague arrived on the scene, PAYNE and ISTED decamped. PAYNE was identified by the Keepers, while P.C. MAYNARD compared ISTED’s boots ... with the footprints at the scene and they exactly corresponded. Both defendants received three months hard labour, and were also ordered on release to find sureties not to offend again within a year, or in default, a further six months’ imprisonment. (“Brighton Gazette 6 Jan 1859” as a footnote.)

b) 1868, 7 Apr: ‘Called on Mr. J. ISTED; her husband in trouble. I called on him in ye hop garden & had a long talk.

A little drink on an empty stomach does sad mischief. Note: John ISTED was arrested for being drunk and disorderly in the village on 4 Apr. [ESRO: QR/E1042].

c) 1870, 19 Jan: Jesse ISTED called poor fellow this evening. Mr. J. COPPARD senior not his immediate master who J.I. said cried over it, turned him away. J.I. lost his temper & swore at him for which he was very sorry but says that Mr. C was nagging at him for ½ hour first. J.I. went away saying he felt comforted and I was glad I was at home. Note: the clear implication is that ISTED was sacked over suspicions of dishonesty, despite the failure to find incriminating goods at this house.

d) 1883, 6 Aug: Called on Mrs. Wm ISTED (10/-) poor woman, parish won’t allow doctor, possibly justly, as her husband earns good money, but liquidates it. Notes: William ISTED born 1836 certainly had a long record of heavy drinking, being first fined for drunkenness in Oct 1856. On 14 Feb 1857 he left the Bear Inn about 1 am ‘and having had a good deal to drink Henry MATTHEWS lead me to my house in Burwash and left me in the kitchen and I fell asleep.’ He had at least one poaching conviction (1857) and two for assault, both on the police. The first was a simple matter on Christmas Day 1858, and the second on very violently resisting the police when caught robbing a barn, for which he received nine months hard labour. He served another prison term, of two months, technically for vagrancy, after being found in the garden of the Revd Granville CLARKE. Thereafter he was probably a more accomplished and circumspect drinker, and there is no record of further convictions in the local courts. Returns of summary convictions, and depositions in case against MATTHEWS, April1857, [ESCRO QR/E996: 1000; 1046. Brighton Gazette 3 Feb 1859].

e) 1885, 26 Oct: Sent for to bear testimony to character of Henry ISTED who is in custody for stealing chickens. I called on his mother & shewed how I could do no good. He was convicted for being drunk and riotous in Ticehurst at the last Petty Sessional sitting at Hurst Green & yet poor lad this I believe his first act of dishonesty. His brother (2/-) & sister in great trouble. I am much grieved. A few years ago he was a Sunday School teacher, then went to a master who drank (George LAVENDER) & was himself convicted of receiving stolen goods, learnt bad habits & gradually sank. I had done my best to keep him straight poor lad. Notes: Henry ISTED had at least three convictions for drunkenness since 1880, including that in Feb 1885 when he was fined 10/- with 12/- costs for being drunk at the Bell; then, he claimed that he was subject to epileptic fits, and ‘felt a little queer on this occasion, and William MEOPHAM put him in a stable’. In 1883 he was also fined 5/- and 7/6 costs along with William MASKELL for the traditional Guy Fawkes Day offence of rolling ignited tar barrels in the street. On the current occasion ISTED, accompanied by Edmund LANGRIDGE, had raided fellow labourer William POPE’s chickens, and I and L took four hens and thirteen chickens. As the pair returned at 2 am they were seen on the Burwash-Ticehurst Road by PC William WINDSOR. He stated that ‘When they caught sight of me, L dropped a bag in the hedge, and they kept coming towards me. I went to the bag and found some chickens in it warm. The two passed me. I overtook them. I asked them how they account for the chickens. Both of them said ‘We don’t know anything about them’. I told them I would apprehend them. ISTED took his belt off his waist and said ‘If you put your hand on me, I will show you’. I told them both that if they attempted to run away, I should knock them down. After a lot of persuasion, I got them to the station’. Here WINDSOR removed the prisoners’ shoes, and later that morning found tracks made by them near POPE’s cottage. POPE later identified the stolen birds as his. In court ISTED’s current employer gave him a good character reference, but COUTHORPE chairing the Bench, and sentencing them both to 3 months hard labour, caustically stated that ’it was all they could give, otherwise they would have given them more.’ [ESCRO QR/E1089, 1104, 1109, Sussex Agricultural Express, 30 Oct 1885, Sussex Advertiser 2 Mar 1883.]

The Will of Thomas HISTED late of Crowborough Rotherfield in the County of Sussex, Shoemaker, deceased who died 24 July 1869 at Crowborough aforesaid was proved at Lewes by the oaths of Ambrose HISTED of Buxted in the County aforesaid Shoemaker, the brother and Richard PRATT of Crowborough aforesaid Miller, the Executors. Effects under £100. Of interest in this will is the following -

(Will made 1 March 1866) ‘... upon trust in the first place to pay and satisfy the following legacies (that is to say) the sum of £10 to my wife’s son Jesse PILBEAM; to sum of £10 to each of my granddaughters: Elizabeth GROVES and Mary Ann GROVES; the sum of £10 to my granddaughter Margaret HOLMWOOD and the sum of £10 to my daughter Mary Ann the wife of Amos PRICE to whom I give the same. And then do and shall stand possessed of the net residue of the said trust money. As to one fourth part thereof in trust for my son George HISTED. As to one other fourth part thereof upon trust for my son Thomas HISTED. As to one other fourth part thereof in trust for my daughter Mary Ann the wife of Amos PRICE. And as the remaining one fourth part thereof in trust to my granddaughter Isabel Jane HISTED. Provided nevertheless and I do hereby declare that notwithstanding anything hereinafter contained to the contrary if from illnesses and affliction or other unavoidable cause during the widowhood of my said wife. The annual income of my property shall not in the opinion of my executors or administrators for the time being sufficient for the proper maintenance and support of her my said wife and my granddaughter the said Isabel Jane HISTED who is a cripple.’

61. [Windmills by Suzanne BEEDELL (1975) page 55-56*] - Removal on 31 Aug 1877 of a mill in Cross St, Worthing owned by Mr ISTED {ie Edward 1838-1886 – link to [D2e] tree of East Grinstead}. ‘ On 31 August 1877 the Cross Street mill in Worthing, Sussex was to be moved out of town. The mill was owned by Mr ISTED, who left no exact record of why he wished to move it, but there were already several mills in the vicinity so perhaps he felt that by moving out into open country he would get more work. The mill was dismantled and the machinery, millstones, windshaft and sweeps were moved to the new site. Once the mill had been jacked up and the trestle and post removed they too would have been taken to the site if they were sound, or new timbers found to replace them. What was left was the “buck” which is the large exterior housing of the windmill. Mr ISTED hired forty horses to move his mill – can you imagine harnessing up forty excited horses to be moved off in unison?! Pulling windmills around the countryside was not an everyday job, and the sight of a large mill, even without its sails, pursuing them down the road, could have been too much for the nerves of the horses, so they probably had to be blinkered. The procession also provided a huge spectacle for the local residents. All went well until the horses tried to turn their awkward load around one particular corner, where the mill stuck. The man in charge of the horses gave up, unhitched his horses and went home. So did the spectators, for the next day promised to provide a lot more fun. Mr ISTED had to get the mill out of the middle of Worthing somehow! He made contact with a man who had recently acquired the very latest in steam traction engines and Mr ISTED was able to contract him to complete the job with two of them, though it is possible only one was needed. This proved successful. A retired architect was one of the spectators and drew a picture of the scene which is published in the book. The mill continued to work until 1892 and was demolished in 1903.’

Joined 16 Lancers at Dublin 20 Apr 1887. Born Amfield, Battle, Sussex. Age 18 yrs 2 mths. He was a Butcher. Was currently a member of 3rd Royal Sussex Regiment. 63. Mid Sussex Times 6 Jan 1989* Looking Back 100 years ago (January 3, 1889) –

‘Assault at Chailey Workhouse. At H.M. Prison on Thursday, James ISTED of Scaynes Hill was further charged with attempting to murder Thomas WHYBORN at Chailey Workhouse on November 30. The injured man has so far recovered and will be able to give evidence next week.’

{NB James ISTED was either: born 1849 Lindfield son of Picknell/Hope, married 1875 Brighton, died 1922 Hellingly; or born 1864 Linfield illegitimate son Emily ISTED (she was born 1847 d/o Picknell/Hope); married 1891 Lindfield; died 1927 Lindfield. Would probably find further information by checking newspapers (eg Sussex Express) about 3 January 1889.}

64. [ESRO: Aber 2/10/4, page 368] 1st proclamation 16 October 1890, Nimrod HISTED -

Nimrod HISTED of Pilmer Road, Crowboro', labourer, in consideration £20 surrended to lord, small piece of land now in occupation of Nimrod HISTED - 30 rods situated at Crowboro' abutting on east and south lands of Goldsmith's company; on west & nth west to an occupation? road leading from Crowboro' Cross to Hourne? Wood. On the north to land and premises late William ARNOLD; on south land to William PEERLESS being part of copyhold tenement, said premises to use of Nimrod HISTED and his heirs; heriot 2/- 6d. Nimrod HISTED admitted 1/- yearly, paid by Nimrod for his portion of tenement and Ambrose HISTED 1/6d for his portion.

{NB Nimod HISTED born 1857 Rotherfield son of George/Hannah nee CRITTALL, unmarried; died 1936. I think Ambrose HISTED was an uncle of Nimrod – born 1813 Rotherfield; married 1835 Buxted died 1888 possibly at Rotherfield.}

65. [Picture Postcard Monthly June 1994, page 32*] Thomas NYE and Joseph ISTED found a flint nodule in 1898 near Lewes. Due to its lightness, Thomas cut it open and found a mummified toad inside. (there is a picture of a Postcard depicting this flint/toad - the postcard, a “Frisby” series, sent to East Hoathly in March 1905.) {Joseph ISTED was born 1841 Southover, Sussex son of Edmund/Sarah; unmarried; he was a bricklayer’s labourer; died 1916.}
